1. Acceptance of Terms

By downloading, installing, or using the Kreev mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Kreev is a personal health informatics platform that reads biometric data from Apple HealthKit and computes personalized wellness analytics, including:

  • A daily Recovery Score (0–100) derived from your personal physiological baseline
  • Autonomic Intelligence metrics (HRV trends, stress index, sleep quality)
  • Longitudinal aerobic capacity tracking (VO2 Max)
  • AI-generated wellness narratives

Use of Kreev requires an iPhone running iOS 16 or later and an Apple Watch or compatible wearable syncing to Apple Health. You are responsible for maintaining your device, internet connectivity, and any associated costs.

Kreev is not a medical device. Scores, narratives, and all outputs are personal informatics derived from your own baseline data. They are not clinical assessments, diagnoses, or treatment recommendations. Do not use Kreev as a substitute for professional medical advice.

2.1 Beta Program

Kreev is currently offered as a closed beta through Apple's TestFlight program. The beta is offered exclusively to residents of Alberta, Canada. If you are not a resident of Alberta, you are not eligible to participate and should not enroll. By participating in the beta, you acknowledge and agree:

(a) Pre-release software. The App is provided to you for testing and feedback purposes. It may contain defects, errors, incomplete features, or unexpected behavior, and it is not warranted to be of merchantable quality.

(b) No service-level commitment. During the beta, Kreev makes no commitment regarding uptime, availability, response times, or feature stability. Recovery Scores, narratives, and other outputs may be revised, recomputed, withdrawn, or temporarily unavailable.

(c) Possible data changes. We may revise the Recovery Score algorithm, baseline window, or scoring logic during the beta period. Historical scores may be recomputed or marked as such when these changes occur.

(d) Not a medical device. Kreev is not a medical device, does not provide medical advice, diagnosis, or treatment, and is not a substitute for professional healthcare. This applies at all times, but especially during the beta when outputs may be unstable. You agree to continue following your physician's advice and to not make medical decisions based on Kreev's outputs.

(e) Beta participant benefit. All participants enrolled in the closed Alberta beta will receive 6 months of complimentary Sentinel-tier access at no cost beginning on the public release date. The complimentary period is non-transferable, applies only to enrolled beta participants, and does not auto-renew — at the end of the 6 months, your account reverts to the free tier described in Section 5.6 unless you choose to subscribe at the then-current public price. We invite, but do not require, beta participants to use the App for at least 14 consecutive days and to complete the Day 7 and Day 14 in-app feedback surveys, as your feedback materially helps us prepare for public release.

(f) Feedback license. If you provide feedback, suggestions, ideas, screenshots, or descriptions of bugs through TestFlight, the in-app surveys, email, or any other channel, you grant Kreev Informatics Inc. a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, and incorporate that feedback into the App and related products without obligation or compensation to you.

(g) Beta confidentiality. While you may share that you are participating in the Kreev beta, we ask that you do not publish screenshots, performance comparisons, or detailed reviews of unreleased features in public forums until those features are released to the public.

(h) Beta termination. We may end the beta program, modify its scope, or transition to a paid public release at any time. We will provide at least 30 days' notice of any transition that materially affects your access. The 6-month complimentary Sentinel access in subsection (e) survives beta termination for participants enrolled at the time of termination.

3. Eligibility

You must be at least 18 years of age to use Kreev. By using the App, you represent that you meet this requirement.

4. Account Registration

You may create an account using Apple Sign-In. You are responsible for maintaining the security of your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions and Billing

5.0 Beta Pricing

During the beta program, all features described as "Sentinel" features are provided to beta participants at no cost. The free trial mechanics described in Section 5.2 do not apply during the beta period.

All enrolled Alberta beta participants will receive 6 months of complimentary Sentinel-tier access beginning on the public release date, as described in Section 2.1(e). After this 6-month complimentary period ends, your account will revert to the free tier described in Section 5.6 unless you choose to subscribe at the then-current public price.

5.1 Subscription Plans

Kreev offers a free tier and a paid "Sentinel" tier. Subscription pricing will be published following the beta testing phase.

5.2 Free Trial

New users receive a 30-day free trial of Sentinel. The trial begins when you create your account and includes full access to all Sentinel features. You will not be charged during the trial period. At the end of the trial, if you have not subscribed, your account will be downgraded to the free tier. You will retain access to your raw health metrics but will lose access to the Recovery Score, full AI narratives, VO2 Max tracking, Trends, History, and Guardian Alerts. No data is deleted when your trial expires.

5.3 Auto-Renewal

Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date. The renewal charge will be applied to your Apple ID account.

5.4 Cancellation

You may cancel your subscription at any time via iPhone Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.

5.5 Price Changes

We may change subscription pricing with at least 30 days' notice. You will be notified via the App or email. Continued use after the price change constitutes acceptance.

5.6 Free Tier

The free tier provides access to basic health metrics (HRV, RHR, Sleep, Steps, Respiratory Rate) and the qualitative stress tier. Features such as the Recovery Score, full AI narratives, VO2 Max tracking, Trends, History, and Guardian Alerts require an active Sentinel subscription.

6. Health Data and HealthKit

By granting Kreev access to Apple HealthKit, you authorize the App to read the health data types listed in our Privacy Policy for the purpose of computing your Recovery Score and wellness metrics. Kreev v1.0-Beta supports Apple HealthKit only; data must be synced to HealthKit by an Apple Watch or another HealthKit-compatible source.

You may revoke HealthKit access at any time via iPhone Settings → Privacy & Security → Health → Kreev. Revoking access will limit the App's ability to compute current scores but will not delete previously stored data (use Purge Vault in Settings for full deletion).

7. AI-Generated Content

Kreev uses Google Gemini (Google LLC) to generate wellness narratives. These narratives:

  • Are generated from anonymized metric values
  • Reflect statistical patterns in your biometric data
  • Are informational observations, not medical opinions
  • May contain errors, inaccuracies, or biases inherent in large language model technology
  • Are generated by a third-party model and do not represent Kreev's own clinical assessment
  • May change, be updated, or become temporarily unavailable as the underlying AI technology evolves

You must exercise independent judgment before acting on any AI-generated content. You agree not to rely on AI-generated narratives as a basis for medical decisions. To the maximum extent permitted by law, Kreev bears no liability arising from AI-generated content.

8. Guardian Alerts

Kreev's Guardian Protocol sends push notifications when your Recovery Score drops below a threshold you configure. These alerts are informational only. They do not constitute an emergency response system and should not be used as a substitute for emergency medical services.

9. Prohibited Uses

You agree not to:

  • Use the App for any unlawful purpose
  • Reverse engineer, decompile, or modify the App
  • Attempt to gain unauthorized access to our systems
  • Use the App to transmit malicious code or interfere with other users

10. User Data

By using Kreev, you grant us a limited license to use your anonymized and aggregated health data to improve the Kreev service, including refining scoring algorithms and AI narrative quality. This data will be de-identified so that it cannot be linked back to you. We will never publish identifiable user data.

11. Intellectual Property

All content, features, and functionality of the Kreev App — including the Recovery Score algorithm, design system, and AI narrative templates — are the exclusive property of Kreev Informatics Inc. and are protected by applicable intellectual property laws.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RECOVERY SCORES ACCURATELY REFLECT YOUR PHYSIOLOGICAL STATE.

KREEV IS NOT A MEDICAL DEVICE AND MAKES NO MEDICAL REPRESENTATIONS. ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL FOR MEDICAL CONCERNS.

DURING THE BETA PROGRAM, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITH ALL FAULTS, WITHOUT WARRANTY OF ANY KIND. BETA PARTICIPANTS ACKNOWLEDGE THAT BUGS, INCOMPLETE FEATURES, AND UNEXPECTED BEHAVIOR ARE INHERENT IN PRE-RELEASE SOFTWARE AND ASSUME ALL RISK ARISING FROM SUCH USE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KREEV INFORMATICS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO RELIANCE ON RECOVERY SCORES OR AI-GENERATED NARRATIVES FOR HEALTH DECISIONS.

IN NO EVENT SHALL KREEV INFORMATICS INC.'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO KREEV IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS ($100 CAD).

14. Indemnification

You agree to indemnify and hold harmless Kreev Informatics Inc., its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your reliance on Recovery Scores or AI-generated content for health decisions.

15. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. We may also suspend or terminate accounts in connection with the conclusion or restructuring of the beta program (see Section 2.1(h)).

You may terminate your account at any time via Settings → Delete Account → Purge Vault. Termination by you triggers the data deletion sequence described in Section 8 of our Privacy Policy.

16. Dispute Resolution

Any dispute arising from these Terms shall first be addressed through good-faith negotiation by contacting legal@kreev.app. If unresolved within 30 days, disputes will be submitted to binding arbitration in accordance with the Arbitration Act (Alberta), conducted in Calgary, Alberta. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Kreev Informatics Inc.

17. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law principles.

18. Limitation on Claims

Any claim arising from your use of Kreev must be filed within one (1) year of the date the claim arose, or it shall be permanently barred.

19. Apple App Store Terms

Kreev is made available through the Apple App Store. Your use of Kreev is also subject to Apple's App Store Terms of Service. You acknowledge that:

(a) These Terms are between you and Kreev Informatics Inc. only, not Apple;

(b) Apple has no obligation to provide maintenance or support for Kreev;

(c) Apple is not responsible for any product warranty claims;

(d) Apple is not responsible for addressing any claims related to Kreev, including product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation;

(e) In the event of any third-party claim that Kreev infringes a third party's intellectual property rights, Kreev Informatics Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim; and

(f) Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

20. Severability and Assignment

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without your consent, provided such assignment does not materially diminish your rights.

21. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kreev Informatics Inc. regarding the use of Kreev and supersede all prior agreements.

22. Algorithm Transparency and Automated Scoring

22.1 How Your Recovery Score Works

Kreev computes your Recovery Score using Z-score normalization against your personal rolling baseline. Each biometric metric (HRV, Resting Heart Rate, Sleep, Steps, Respiratory Rate) is compared to your own historical average from the preceding 7–60 days. The resulting Z-scores are weighted and mapped to a 0–100 scale. This approach means your score reflects deviation from your own patterns, not comparison to a population group.

22.2 No Demographic Profiling

The Recovery Score and Stress Index do not use your age, sex, ethnicity, location, or any demographic attribute. The only feature that uses demographic data is the optional VO2 Max percentile ranking, which requires you to voluntarily provide your age and biological sex.

22.3 Automated Decision Rights

You have the right to:

  • Request explanation of how your Recovery Score or Stress Index was computed for any given day by contacting privacy@kreev.app
  • Opt out of automated scoring by revoking HealthKit permissions or contacting privacy@kreev.app (this will disable Recovery Score, Stress Index, and AI narrative features)
  • Access all outputs including historical scores and AI-generated narratives associated with your account

22.4 Limitations

Automated scores are personal informatics based on sensor data and statistical methods. They are not clinical assessments. Sensor accuracy depends on hardware (Apple Watch or compatible wearable) and user behavior (consistent wear, proper fit). Scores during the first 7 days of use may be less stable due to limited baseline data.

23. Export Compliance

You represent that you are not located in a country subject to a government embargo and that you are not on any government restricted-parties list.

24. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification. Continued use after changes constitutes acceptance.
